JOB PURPOSE
To assist the General Manager, Retail in ensuring regulatory, legal, and operational compliance across the retail portfolio, safeguarding the company’s interests as a property owner and stakeholder in strata-titled developments. This role is critical in mitigating legal and compliance risks, enhancing governance standards, and supporting sustainable asset performance. This role will assist the General Manager, Retail Operations who is the corporate representative and appointed liaison involving Joint Management Bodies (JMB) and Management Corporations (MC), in representing the company’s position in JMB/MC meetings, legal proceedings, mediations, and stakeholder negotiations. The position also drives the development and enforcement of compliance frameworks, audit programs, and internal controls and Standard Operating Procedures (SOPs) that uphold corporate integrity and operational excellence within the Commercial Division.
JOB ACCOUNTABILITIES
1) Retail Compliance Oversight
- Lead the development, implementation, and continuous improvement of compliance frameworks across the Commercial Division portfolio.
- Ensure compliance with relevant laws and regulations including SMA, Suruhanjaya Tenaga, Housing Development Act (HDA), and KPKT guidelines.
- Review and advise Retail Operations on Standard Operating Procedures (SOPs) to ensure alignment with regulatory, company policy and corporate governance standards.
- Establish and update the Retail Operations’ Limit of Authority (LOA) delegation to reflect evolving operational and compliance needs.
- Promote a strong compliance culture through awareness, training, internal communications, regular reviews and cross-functional collaboration
2) Audit and Monitoring
- Plan and conduct yearly or ad-hoc audits on Commercial portfolio projects to assess compliance, efficiency, and system integrity.
- Utilize compliance tools such as audit checklists, digital audit platforms, and risk assessment matrices.
- Prepare comprehensive audit reports with actionable insights and recommendations
- Follow up on audit outcomes to ensure timely implementation of corrective actions and continuous improvement.
3) Retail Planning & Development
- Represent the Commercial Division in coordinating with internal stakeholders (Development/Project) and appointed consultants on strata line demarcation for new projects before construction and/or strata title submission.
- Provide compliance insights during project planning to ensure future operational readiness and legal compliance.
- Review and validate development documentation to protect the company’s interest in shared property components.
4) Stakeholder Management
- Primary liaison between Retail Operations and both internal Legal teams and external counsel on matters related to JMB/MC governance, disputes, and proceedings.
- Assist the General Manager, Retail Operations who acts as Corporate Representative or Observer at all JMB/MC meetings, providing strategic input and consultancy on project and operational matters.
- Lead and conduct due diligence for ongoing or potential legal proceedings involving UEMS/SV-owned property or management disputes.
- Represent the company as a witness during mediation, tribunal hearings, or court proceedings, ensuring accurate representation of the company’s position and documentation.
- Review JMB/MC Annual General Meeting (AGM) documents and ensure timely submission of all required documentation, including proxy forms and company resolutions.
- Draft and coordinate official correspondences with JMB/MC on behalf of UEMS/SV and its subsidiaries.
5) Risk & Compliance
- Respond to and support the resolution of findings and recommendations issued by the Internal Audit Department.
- Monitor and regularly update the status of high-risk or critical compliance items to senior management, ensuring proactive risk mitigation.
- Maintain documentation and audit trails to demonstrate compliance efforts and readiness for future reviews.
MINIMUM ESSENTIAL QUALIFICATIONS & TECHNICAL COMPETENCES
- Bachelor’s Degree in Property Management or any other relevant field.
- 6 to 8 years in strata property management, operations management, facility management, retail operations, or relevant industry.
- Experienced in multi-site leadership, stakeholder management, and business strategy.
- Good problem-solving, financial planning, and communication skills to drive operational efficiency and revenue growth
